1. Agreement and Apple terms

By downloading, purchasing, or using SepCalc, you agree to these Terms and the Apple Licensed Application End User License Agreement (“Standard EULA”). SepCalc is licensed, not sold. These Terms supplement the Standard EULA. If they conflict, the Standard EULA and non-waivable law control. If you do not agree, do not use SepCalc.

“SepCalc,” “we,” “us,” and “our” refer to David Seppi, the application provider. “You” means the person or entity using SepCalc. If you use SepCalc for an organization, you confirm that you have authority to bind it and comply with its policies.

2. License and permitted use

Subject to these Terms, the Standard EULA, Apple’s Usage Rules, and your valid entitlement, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to use SepCalc on Apple-branded devices you own or control. Family Sharing, volume purchasing, and managed distribution apply only where Apple and the applicable product configuration permit them.

You may use outputs you create, including calculations, graphs, scripts, data transformations, and reports, subject to rights in source data, third-party content, templates, packages, and provider licenses.

3. Acceptable use and your responsibilities

You will not:

• use SepCalc unlawfully, to infringe rights, defeat access controls, distribute malware, attack systems, or facilitate harm;
• circumvent purchases, entitlements, resource limits, signatures, safety controls, exam restrictions, or provider licenses;
• misrepresent generated or modified work, provenance, certification, or verification;
• upload or transmit information you lack permission to use or disclose;
• reverse engineer, copy, redistribute, sublicense, or make derivative works of SepCalc except where applicable law or an open-source license expressly permits it; or
• use SepCalc or its outputs to develop, manufacture, or operate weapons, or for another prohibited end use under applicable export law.

You are responsible for device security, backups, input accuracy, script behavior, provider credentials, licenses, legal compliance, and reviewing results before relying on them.

4. Calculations, models, and professional use

SepCalc may provide numerical, symbolic, statistical, scientific, engineering, chemical, laboratory, financial, actuarial, credit-risk, tax-related, market, and AI-assisted outputs. Outputs can be affected by input errors, rounding, precision, numerical methods, model limitations, stale or incorrect data, conventions, approximations, software defects, and ambiguous instructions.

SepCalc does not provide investment, financial, accounting, tax, legal, medical, safety, engineering-signoff, laboratory-accreditation, or other regulated professional advice. It is not a broker, bank, fiduciary, credit-rating agency, laboratory, or certification authority. Market examples and model outputs are informational and are not offers, recommendations, guarantees, or predictions.

Do not use SepCalc as the sole control for life safety, diagnosis or treatment, emergency response, structural or electrical protection, regulated laboratory release, trading execution, lending decisions, legal deadlines, or any use where an error could cause death, injury, significant property damage, or material financial loss. Qualified users must independently validate consequential work with appropriate references, controls, and professional review.

5. Your content, scripts, packages, and exports

You retain ownership of content you create and grant SepCalc only the permissions needed to process it at your direction. You are responsible for having rights to imported data, documents, code, packages, templates, media, and credentials.

Embedded Python and user scripting can transform, delete, export, or disclose information within granted permissions. Inspect untrusted code and package provenance before running it. Resource limits, signatures, governance checks, and sandbox controls reduce risk but cannot guarantee that every script or package is safe, correct, compatible, or fit for purpose. Back up important work.

When you share an export, link, report, package, or template, you are responsible for removing sensitive information and complying with applicable confidentiality, attribution, copyright, data-protection, and redistribution obligations.

6. External services and data

SepCalc can open websites and, only when configured and directed by you, communicate with external providers for market data, research, collaboration, or cloud intelligence. External services may require separate accounts, credentials, subscriptions, licenses, consent, or terms. They may change, become unavailable, impose limits, or return incomplete, delayed, inaccurate, or differently licensed content.

We do not control and are not responsible for external services, provider conduct, content, security, retention, availability, pricing, or accuracy. Your use is governed by the provider’s terms and privacy policy. SepCalc’s source-aware snapshots, citations, redaction, and consent controls do not convert third-party information into verified professional advice or grant redistribution rights. The Privacy Policy explains transmission controls.

7. Purchases, subscriptions, and refunds

SepCalc may offer a free tier, a one-time SepCalc Pro purchase, and monthly or annual SepCalc Intelligence subscriptions. Available products, features, trials, introductory offers, currencies, taxes, and prices are those displayed by the App Store at purchase. Intelligence requires an active qualifying entitlement as shown in the app.

Apple processes payment. Auto-renewable subscriptions renew unless canceled at least as required by Apple before the current period ends. Apple charges the payment method associated with your Apple Account and manages cancellation, billing, Family Sharing eligibility, and refunds. Canceling stops future renewal but does not retroactively refund the current period. Access continues through the paid period unless Apple states otherwise.

If Intelligence expires, cloud consent and transmission are disabled. Expiration does not delete your local calculations, documents, or exports, and does not remove a separately owned lifetime Pro entitlement. Use Apple’s billing support to manage a subscription and Report a Problem for refund eligibility.

8. SepCalc and third-party ownership

SepCalc, its design, software, documentation, trademarks, and original content are owned by us or our licensors and protected by intellectual-property law. SepCalc includes open-source components, including a bundled Python runtime, governed by their respective licenses and notices. Those licenses control for the applicable components. Third-party names and marks belong to their owners; reference to a product does not imply sponsorship or endorsement.

Feedback may be used to improve SepCalc without restriction or payment, provided we do not publicly identify you without permission.

9. Availability, updates, and changes

We may add, modify, suspend, or discontinue features; change technical requirements; correct errors; or issue security and compatibility updates. We do not promise that every feature, provider, language, device, integration, or historical data source will remain available. Core offline behavior may still depend on compatible hardware, operating-system capabilities, valid entitlements, and adequate storage.

You are responsible for installing updates and maintaining backups. Beta or prerelease features may be incomplete and should not be used for production or consequential decisions.

10. Disclaimers and limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEPCALC AND ITS SERVICES, CONTENT, AND OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY, QUIET ENJOYMENT, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF PROFITS, DATA, GOODWILL, OPPORTUNITY, OR BUSINESS; OR DAMAGES ARISING FROM INPUTS, OUTPUTS, RELIANCE, EXTERNAL SERVICES, SCRIPTS, PACKAGES, OR INABILITY TO USE SEPCALC. OUR TOTAL LIABILITY FOR ALL CLAIMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR SEPCALC DURING THE TWELVE MONTHS BEFORE THE CLAIM OR US$50.

Some jurisdictions do not allow certain exclusions or limits. In those jurisdictions, these provisions apply only to the fullest extent allowed. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded.

11. Termination, governing terms, and changes

You may stop using SepCalc at any time. Your license terminates automatically if you materially violate these Terms or the Standard EULA. On termination, stop using SepCalc; provisions that by nature should survive—including ownership, disclaimers, liability limits, and dispute terms—will survive.

The governing-law and forum provisions in Apple’s Standard EULA apply, subject to mandatory consumer protections in your place of residence. The United Nations Convention on Contracts for the International Sale of Goods does not apply. If any provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. Failure to enforce a provision is not a waiver. These Terms, the Standard EULA, and incorporated policies form the agreement concerning SepCalc.

We may update these Terms for future use as the product or law changes. We will post the new version and effective date and provide additional notice where required. Continuing to use SepCalc after revised Terms take effect constitutes acceptance to the extent permitted by law.
